§ 1-15. Cost recovery with respect to certain enumerated violations of the Code.

  • (a)

    Failure to obtain proper construction and sign permits. This Code requires obtaining permits in a number of situations, including, for example, construction of all types, fences, basement finishes, water heater installations, furnace replacements, deck additions, pool construction, and the erection or construction of certain signs. In the event the respective permit(s) is/are not obtained in the first instant, an offender shall be required to obtain the necessary construction permit, post the necessary surety, if required, and an administrative recovery fee shall be paid to the city in the amount of the required permit fee, but not less than $100.00. In the case where a contractor is in violation, no additional permits shall be issued to the contractor for any location in the city until the necessary permits are obtained and the administrative recovery fee paid.

    (b)

    Failure to obtain occupancy permits. A landlord who permits occupancy of property without first obtaining the required occupancy permit shall reimburse the city $50.00 in addition to the occupancy inspection fee for each unit found to be occupied without a proper inspection having been conducted and an occupancy permit issued prior to such occupancy.

    (c)

    Grass cutting by the city for violations of weed and vegetation requirements. A property owner who fails to observe the weed and vegetation requirements of the city shall reimburse the city for the administrative cost related to notification in an amount of $100.00, in addition to any other costs imposed by this Code.

    (d)

    Plan review. The submission of the applicable permit fee or $50.00, whichever is less, required for certain permits under this Code shall be made at the time of submission of the plan for the necessary permit and shall be called the permit application fee. The fee paid shall be non refundable, but it shall be applied toward the cost of the required permit fee.

    (e)

    Reinspection requests. The fee paid for a certificate of occupancy inspection shall include the original inspection and one reinspection. If items of deficiency cited in the original inspection have not been corrected at the time of the reinspection an additional reinspection must be scheduled. All additional reinspections in excess of the first reinspection shall require a fee of $50.00 which amount shall be paid to the city before each subsequent reinspection is conducted. No certificate of occupancy shall be issued until all of the cited items from the original inspection have been corrected.
