§ 26-26. Regulations of county health commissioner to be effective; scope of regulations.

  • (a)

    The rules and regulations promulgated by the county health commissioner shall become effective upon approval by the board of aldermen and shall be filed with the city clerk as a public record. The rules and regulations may provide:

    (1)

    The minimum sanitary requirements for the design, equipment, maintenance and operation of swimming pools and bathing places.

    (2)

    The qualification of any lifeguard or attendant at any swimming pool or bathing place.

    (3)

    The minimum safety facilities and apparatus to be installed and maintained at any swimming pool or bathing place.

    (4)

    A maximum bathing load of any swimming pool or bathing place.

    (5)

    The minimum sanitary standards of operation for any wading pool or spray pool.

    (6)

    The data to be submitted with any application for construction, alteration, extension or modification of swimming pools or bathing places and to provide the manner and terms upon which such approval shall be granted or modified.

    (b)

    Any rule or regulation shall meet the minimum standards of the state department of health, but nothing herein shall prevent the county health commissioner from requiring compliance with higher requirements where such higher requirements are essential to maintain a sanitary condition.
