§ 14-291. License required.

  • (a)

    The owner or lessee of real property located in a residential district of the city designated as R-1A, R-1, R-2, R-3, R-4, R-5 or MXD shall not conduct or allow to be conducted on his real property any auction or estate sale unless the property owner has applied to and obtained from the city a license to conduct such auction or sale of merchandise at least 48 hours before the auction or sale of merchandise is held.

    (b)

    The provisions of this section are not to be applied to the legal conduct of garage sales. For the purpose of this section, (i) an estate sale means the sale of personnel property in conjunction with the death or incapacity of the owner, or other sale promoted as an estate sale, (ii) an auction means the sale of property to the highest bidder and (iii) a garage sale is the resale of unwanted personnel and household items from a garage or yard and promoted as a garage sale.
